博闻 | 《东盟投资与贸易中争端解决方式的选择》法律研讨会在上海圆满召开
《东盟投资与贸易中争端解决方式的选择》法律研讨会于2023年10月24在上海仲裁委员会圆满举行。本次研讨会由上海政法学院东盟比较法中心、上海市法学会生命法研究会以及华东理工大学文法学院联合主办，北京大成（上海）律师事务所和上海博芸律师事务所联合承办，并由上海仲裁委员会和国际商会仲裁院提供支持。此次会议吸引了法律界及相关行业的高度关注，汇集了多位行业专家和学者，共同探讨和交流了跨境争议解决的法律策略和实践经验。
The legal seminar on "Choices of Dispute Resolution in ASEAN Investment and Trade" was successfully held at the Shanghai Arbitration Commission on October 24, 2023. This seminar was co-hosted by Shanghai University of Political Science and Law ASEAN Comparative Law Center, Shanghai Law Society Life Law Research Association, and East China University of Science and Technology Law School, with joint organization from Beijing Dacheng (Shanghai) Law Firm and Shanghai Boyun Law Firm, and supported by the Shanghai Arbitration Commission and the International Chamber of Commerce Court of Arbitration. The event garnered high attention from the legal industry and related sectors, bringing together numerous industry experts and scholars to explore and discuss legal strategies and practical experiences in cross-border dispute resolution.
会议伊始，上海仲裁委员会副主任孙海华先生为大家致辞。接下来的议程中，包括上海政法学院东盟比较法中心主任，上海大成律师事务所合伙人谭家才先生在内的六名嘉宾，围绕跨境争议解决等议题进行了深入的分享和探讨。他们的演讲涵盖了国际仲裁在国际工程纠纷中的应用、跨境破产中的问题、Bio-tech“出海”路上的争议解决、东盟医疗健康数据合规概览、跨境裁决申请承认与执行的动态发展等多个方面，为在座的听众提供了宝贵的法律知识和实践经验。同时，会议的最后还进行了一场关于跨境仲裁与跨境诉讼选择的圆桌讨论，进一步丰富了会议的内容，也为参与者提供了一个交流和学习的良好平台。
At the beginning of the seminar, Mr. Sun Haihua, the Deputy Director of the Shanghai Arbitration Commission, delivered a speech to the attendees. Following the opening, six distinguished guests including the Director of the Shanghai University of Political Science and Law ASEAN Comparative Law Center, and Mr. Tan Jiacai, Partner at Beijing Dacheng (Shanghai) Law Firm, delved into various topics surrounding cross-border dispute resolution. Their presentations covered a range of topics including the application of international arbitration in international engineering disputes, issues in cross-border bankruptcy, dispute resolution on the "outbound" journey of Bio-tech, overview of ASEAN medical health data compliance, dynamic development of cross-border adjudication application recognition and enforcement, providing valuable legal insights and practical experiences to the audience. Additionally, a roundtable discussion on the selection between cross-border arbitration and litigation was held towards the end of the seminar, further enriching the content of the seminar and providing a good platform for participants to interact and learn.
